1. Acceptance of Terms
By accessing or using the Sniip Identity platform (the "Service") operated by Sniip Pty Ltd ("Sniip Identity", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
Sniip Identity provides identity verification services including liveness detection, face comparison, and document verification through REST and gRPC APIs. The Service is provided on a subscription basis with various plan tiers.
3. Account Registration
To use the Service, you must create an account and provide accurate, current information. You are responsible for:
- Maintaining the security of your account credentials and API keys
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use
4. API Keys and Access
API keys are confidential credentials. You must:
- Keep API keys secure and not share them publicly
- Not embed API keys in client-side code or public repositories
- Revoke compromised keys immediately through the dashboard
- Use separate keys for development and production environments
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Process biometric data without proper consent from the data subject
- Conduct surveillance or tracking without authorisation
- Attempt to reverse engineer, decompile, or extract our algorithms
- Exceed rate limits or attempt to circumvent usage restrictions
- Interfere with or disrupt the Service or its infrastructure
- Use the Service for any discriminatory purpose
6. Data Processing
You acknowledge that:
- You are the data controller for end-user data processed through the Service
- We act as data processor on your behalf
- You are responsible for obtaining proper consent from end users before initiating identity verification
- You must comply with all applicable data protection laws (including GDPR, CCPA, and the Australian Privacy Act)
7. Subscriptions and Billing
Paid subscriptions are billed monthly. Pricing and plan details are available on our pricing page.
- Subscriptions renew automatically unless cancelled
- Overage charges apply when usage exceeds plan limits (except Free tier, which has a hard cap)
- Invoices are issued monthly and payment is due within 30 days
- We reserve the right to adjust pricing with 30 days notice
8. Service Level
We target 99.9% uptime for Pro and Enterprise plans. Specific SLA terms and remedies are detailed in Enterprise service agreements. We do not guarantee uninterrupted service for Free or Starter plans.
9. Intellectual Property
The Service, including all software, algorithms, documentation, and branding, is owned by Sniip Pty Ltd. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the fees you paid in the 12 months preceding the claim
- We are not liable for decisions made based on verification results
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
12. Termination
Either party may terminate the Service:
- You may cancel your account at any time through the dashboard
- We may suspend or terminate your access for violation of these Terms
- Upon termination, your data will be deleted according to our data retention policy
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the dashboard. Continued use of the Service after changes constitutes acceptance.
